1. About TIMA

TIMA is a software-as-a-service (SaaS) platform that provides marketing, automation, analytics, and related tools. Certain features may require paid subscriptions or third-party integrations.

2. Eligibility

You may use the Service only if:

• You are at least 18 years old
• You have the legal authority to enter into these Terms
• You are not prohibited from using the Service under applicable laws

If you use TIMA on behalf of a company, you confirm that you are authorized to bind that company.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscriptions and Payments

4.1 Paid Plans

Some features require a paid subscription. By subscribing, you agree to pay the applicable fees as described at the time of purchase. Fees are stated exclusive of any applicable taxes unless indicated otherwise. We may change prices for future billing periods with prior notice; continued use after a price change takes effect constitutes acceptance.

4.2 Billing and Automatic Renewal

Subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically at the end of each billing period until cancelled. You authorize us to charge your payment method automatically. You are responsible for keeping a valid payment method on file; failed payments may result in suspension of access.

4.3 Cancellations

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Until then you retain full access to your paid plan and any remaining credits. Cancelling stops future renewals and future credit refills; it does not entitle you to a refund of any amounts already paid.

4.4 Immediate Start of Service; Acceptance

Your subscription starts immediately upon payment, and the Service — including the credit allowance for your plan — is made available to you at that moment. By completing a purchase you (a) accept these Terms in full, (b) expressly request that we begin performing the Service immediately, before the end of any statutory withdrawal period, and (c) if you are a consumer in the EU/EEA, you expressly acknowledge that by receiving immediate access to the Service and its digital content you lose your 14-day right of withdrawal under applicable consumer protection law.

4.5 No Refunds

All payments are final and non-refundable. Except where a refund is required by mandatory applicable law, TIMA does not issue refunds or credits of any kind — including, without limitation, for partial billing periods, unused time, unused or remaining credits, downgrades, dissatisfaction with the Service or with generated output, forgetting to cancel before a renewal, changes in your business needs, or account termination resulting from your violation of these Terms. Choosing not to use the Service after paying for it does not entitle you to a refund.

4.6 Credits

Plan credits are a usage allowance, not money. Credits have no monetary or cash value, are non-transferable, cannot be redeemed, exchanged, or paid out, and expire when your account is closed or terminated. Promotional or bonus credits may be modified or withdrawn at any time. We may adjust how many credits individual features consume; material changes will be reflected in the product.

4.7 Chargebacks and Payment Disputes

If you believe a charge was made in error, you agree to contact us at support@tima.wtf before disputing it with your bank or card issuer. Initiating a chargeback for a valid charge is a material breach of these Terms; we may suspend or terminate your account immediately, revoke any remaining credits, and recover the disputed amount together with reasonable costs and dispute fees incurred.

4.8 Trials and Promotional Access

If a free trial or promotional access is offered, it converts into a paid subscription at the end of the trial unless cancelled beforehand. We may modify or end trials and promotions at any time. Trial and promotional access carries no entitlement to any particular features, credits, or continued availability.

5. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or attempt to compromise the Service
• Use the Service for spam, harassment, or fraudulent activities
• Attempt to gain unauthorized access to other accounts or systems
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are owned by Adventure Labs d.o.o. and are protected by intellectual property laws.

6.2 Your Content

You retain ownership of content you upload to the Service. By uploading content, you grant us a non-exclusive, worldwide license to use, store, and process that content solely to provide the Service.

7. Third-Party Integrations

The Service may integrate with third-party platforms (e.g., Meta Ads, social media). Your use of these integrations is subject to the respective third-party terms. We are not responsible for the availability or content of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVENTURE LABS D.O.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Adventure Labs d.o.o. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may also terminate your account at any time.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Croatia. Any disputes arising from these Terms shall be resolved by the competent courts in Zagreb, Croatia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
